Terms of Sale for Physical Products

These Terms of Sale (“Terms”) govern the purchase of physical products (“Products”) offered by Safe Sea (“we”, “us”, or “our”), located at Jordan Valley, Israel, 1510500.

By purchasing our Products, you also agree to our Terms of Service and Privacy Policy. Customers located in the EU, UK, and Québec should refer to Section 10 for additional information.

Please note that your rights related to your purchase of the Products may depend on your place of residence. Products Safe Sea’s Products include a variety of sun protection items available on our website (www.safesea.store). You are not required to make a purchase to browse Safe Sea’s website. However, if you do not purchase a product, your access to certain features of the website may be limited.

Safe Sea reserves the right to modify the content, type, and availability of any Product at any time. If you do not cancel your order for the Products after the modifications become effective, you agree to the modifications.

Orders

a. Auto-renewing Orders: If you purchase a recurring order, your Products order, which may start with a promotional rate, will auto-renew at the frequency stated at the time of your order unless cancelled. You will be charged your first order fee and any applicable taxes on the date you purchase your Products or after your promotional period ends. Your Products order will automatically continue at the stated interval, and you will continue to be charged at the stated price (including any applicable taxes) at the beginning of each billing cycle (“Billing Period”) unless prior to the end of your current Billing Period: (a) you terminate your account; (b) you cancel your order (as described below); (c) we decline to renew your order; or (d) these Terms of Sale are otherwise properly terminated as expressly permitted herein.

You can view the date of your next scheduled payment by visiting our website and clicking on the “My Account” link. If any order fee is not paid in a timely manner, or your transaction cannot be processed, we reserve the right to suspend, disable, cancel or terminate your Products order.

b. Differing Orders/Promotions: Safe Sea may offer a number of types of orders, including orders to different Safe Sea products and special promotions.

Any materially different terms from those described in these Terms of Sale will be disclosed at the time of purchase or in other communications made available to you. We reserve the right to change or terminate any offered orders or promotions at any time.

c. Locked-In, Fixed-Rate Orders: Safe Sea may, in its sole discretion, offer an order in which you agree to pay a recurring, locked-in fixed order rate each billing cycle until cancelled. If such order is ever cancelled or terminated for any reason, you will permanently lose your fixed-rate and may not be able to take advantage of another fixed-rate order, although you may be able to re-order at other rates offered by Safe Sea for a specified period of time.

Billing

a. Payment Method: You can pay for your order with a major credit card or through other payment methods (e.g., PayPal) made available during the purchase process (“Payment Method”). Accepted Payment Methods may vary based on your location. You may edit your Payment Method information by visiting our website and clicking on the “My Account” link. If your payment is unsuccessful due to insufficient funds, expiration, or otherwise, you remain responsible for any unfulfilled payments and authorize us to continue billing the Payment Method, as it may be updated. This may result in a change to your payment billing dates.

b. Recurring Billing: By initiating an order, you authorize us to charge you for your initial order fees at the then current rate, and any other charges you may incur in connection with your use of the Safe Sea service, such as taxes and possible transaction fees. You acknowledge that the amount billed each billing cycle may vary for reasons that may include differing amounts due to promotional offers, and you authorize us to charge your Payment Method for such varying amounts.

c. Price Changes: We reserve the right to adjust pricing for our service or any components thereof in any manner and at any time as we may determine in our sole and absolute discretion. Except as otherwise expressly provided for in these Terms of Sale, any price changes to your service will take effect following email notice to you.

d. Refunds: Payments are nonrefundable and there are no refunds or credits for partially used periods. Following any cancellation, however, you will continue to have access to the service through the end of your current billing period.

Shipping and Delivery

a. Shipping Costs: Shipping costs for the Products are additional unless otherwise indicated at the time of sale. Shipping costs will be calculated and displayed at checkout.

b. Delivery Estimates: While we will use reasonable efforts to fulfill your order, we cannot guarantee any firm delivery dates. You agree that Safe Sea will not be responsible for any delays in delivery of Products.

c. Risk of Loss: All items purchased from Safe Sea are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

Returns and Exchanges

a. Returns: If you are not completely satisfied with your Safe Sea purchase for any reason, please review our return policy, which is available on our website or by contacting our customer service.

b. Exchanges: We only replace items if they are defective or damaged. If you need to exchange it for the same item, send us an email at support@safesea.store.

By continuing to access or use our service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the service.

Governing Law These Terms shall be governed and construed in accordance with the laws of Israel, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our service, and supersede and replace any prior agreements we might have had between us regarding the service.
